1.1. THIS SOFTWARE IS PROVIDED BY STILTSOFT "AS IS" AND ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED. IN NO EVENT SHALL STILTSOFT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THIS SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
2.1. You are given a non-exclusive license to store, load, install, execute the Software.
2.2. The licenses granted are subject to the condition that the Licensee must ensure the maximum number of users accessing and using the Software concurrently is equal to the number of User Licences for which the necessary Fees have been paid to the Reseller.
2.3. The Licensee is permitted to copy the Software for data protection, archiving and backup purposes. However, only the strictly necessary number of backup copies may be made.
2.4. StiltSoft may provide evaluation copies of the Software for customers to assess the Software. If the Software is only provided for evaluation purposes the rights of the Licensee are limited to download, install, use and operate the Software for a limited period. On the expiry of the Evaluation Period the Software will cease to function and the Licensee must remove and delete all copies of the Software in its possession.
3.1. A one-time fee, where applicable as designated by product, is paid by Licensee to Reseller in consideration for the authorised use of the product. License fee is non-refundable and payable upon acceptance of the terms and conditions set out herein.
3.2 In some cases (e.g. OpenSource of NonProfit license) license fee is not collected. List of such cases is determined by StiltSoft and may be subject to changes without notice.
4.1. You shall not rent, lend, lease, sell, modify, decompile, or reverse engineer the Software or create derivative works based on the Software or any portion thereof.
4.2. You shall not transfer the rights to use the Software to any third party.
4.3. You shall not provide the license key to third parties.
5.1. StiltSoft provides one-year online Software maintenance for Licensee who pays License fee and accepts the terms and conditions set out herein.
5.2 StiltSoft provides support via e-mail (support@stiltsoft.com) or the feedback form at the StiltSoft web-site.
5.3. No additional maintenance fees are collected.
5.4. Support of evaluation copies of Software is provided only until the expiration of evaluation period of Software.
5.5. Support includes the provision of access for every update of purchased version during the term of 1 year.
5.6. StiltSoft may refuse to support an evaluation or free version without any explanation.
6.1. Licensee grants StiltSoft the right to include Licensee as a customer in Software promotional material. Licensee can deny StiltSoft this right at any time by submitting a written request via email to support@stiltsoft.com, requesting to be excluded from Software promotional material.
